When a government wages war and aggression against another government, the entrance of the people and the government of the second country to defend itself becomes inevitable. Human casualties, such as the death or injuring of a number of forces involved or the capture of a number of others, are an integral part of the war.The purpose of this study is to analyze and evaluate the operation of the two countries. To achieve this goal, the library method (based on documentary and library sources) and descriptive and analytical approach have been used. The theoretical framework of the research is based on the 1949 Geneva Conventions on how to hold and exchange captives of war under the surveillance of the International Committee of the Red Cross.The results of the research show that the process of exchanging captives started in 1981 and until 2003, in different stages, 95,835 captives of both sides were exchanged and returned to their country; Also, based on the documents and records in the archives, we find that the Iranian government's approach to the Iraqi government has been based on human rights, international law and humanitarian law.Keywords: Iran and Iraq war, Iranian and Iraqis captives, International Committee of the Red Cross}, keywords = {Iran,Iraq,War}, title_fa = {واکاوی وتحلیل چگونگی تبادل اسرای جنگ ایران و عراق(1359-1367)}, abstract_fa = {گرچه جنگ به‌عنوان پدیده‌ای زشت و ناپسند همزاد دیرین تاریخ بشر میباشد ولی گاه درگیر شدن در آن اجتناب‌ناپذیر است؛ زمانی که دولتی اقدام به جنگ و تجاوز بر علیه دولتی دیگر می‌کند ورود مردم و دولت کشور دوم برای دفاع از خود اجتنابناپذیر می‌شود. تلفات و صدمات انسانی همچون کشته یا زخمی شدن تعدادی از نیروهای درگیر و یا به اسارت درآمدن شماری دیگر از آنها جزء لاینفک جنگ است.هدف از پژوهش حاضر واکاوی تحلیل و ارزیابی عملکرد دو کشور است. برای رسیدن به این هدف از روش کتابخانه‌ای (بر پایه منابع اسنادی و کتابخانه‌ای) و رویکرد توصیفی و تحلیلی استفاده شده است. چارچوب نظری تحقیق بر مبنای قوانین کنواسیون 1949میلادی ژنو در مورد چگونگی نگهداری و تبادل اسرای جنگی تحت نظارت کمیته بین‌المللی صلیب سرخ می‌باشد. نتایج پژوهش نشان‌دهنده این است که جریان تبادل اسراء از سال 1360 شروع شده وتا سال 1382 در مراحل مختلف، تعداد 95835 نفر از اسیران دو طرف مبادله شده و به کشورشان بازگشته‌اند؛ همچنین بر اساس مستندات و صورتجلسات موجود در آرشیو اسناد درمی‌یابیم که رویکرد دولت ایران نسبت به دولت عراق مبتنی بر موازین انسانی، حقوق بین‌المللی و بشردوستانه بوده است.}, keywords_fa = {جنگ ایران و عراق,اسیران ایرانی و عراقی,کمیته صلیبسرخ بین‌المللی}, url = {https://hds.sndu.ac.ir/article_1541.html}, eprint = {https://hds.sndu.ac.ir/article_1541_6962d8ddaf3f7e2a3c462b2d43c8507d.pdf} }
