Contrary to the Charter's stipulation, based on the teachings of customary international law, if there is an immediate threat indicating an imminent enemy attack, Governments can attack the threat centers and take action to eliminate the threats. From a jurisprudential perspective, defensive struggle (Jihad) is an individual and urgent obligatory that does not require the permission of the infallible Imam. Defensive struggle (jihad) means fighting polytheists, infidels, rebels, and any enemy who is feared to overthrow the Islamic state and who is feared to dominate the Muslim lands. The reason for this type of struggle is to preserve the policy of religion, preserve the Islamic state, guard the religion and prevent its destruction, guard the honor and reputation of Muslims, and establish security in the Islamic society. In this article, which will be written in a descriptive-analytical manner, the legitimacy of preemptive defense can be proven by considering things like the existence of conclusive evidence of an attack, the priority of the defensive expediency, and the lack of the need for the permission of the infallible Imam, and by citing the generality of the evidences for the obligation of armed struggle (Jihad), Hadiths, and the concept of the guardianship of the jurist. استفاده از زور در روابط بین‌الملل نامشروع است و در منشور ملل متحد این قاعده سخت در مورد امنیت جمعی و دفاع مشروع تخصیص خورده است. بر خلاف تصریح منشور، بر بنیاد آموزه‌‌های حقوق بین‌الملل عرفی در صورت وجود تهدید فوری که نشان از حمله قریب‌الوقوع دشمن داشته باشد، کشورها می‌توانند به مراکز تهدیدزا حمله و نسبت به از بین بردن تهدیدات اقدام نمایند. از منظر فقهی جهاد دفاعی، واجبی عینی و فوری است که نیازی به اذن امام معصوم ندارد. منظور از جهاد دفاعی، جنگیدن با هر دشمنی است که نسبت به براندازی حکومت اسلامی نسبت به او ترس وجود دارد و بیم آن می‌رود که بر سرزمین مسلمانان سیطره یابد. دلیل این نوع جهاد، حفظ خط‌مشی دین، اصل حکومت اسلامی، نگهبانی از شریعت و مراقبت از نابودی آن، نگهبانی از شرف و آبروی مسلمانان و استقرار امنیت در جامعه اسلامی است. در این نوشتار که به شیوه توصیفی ـ تحلیلی نگارش یافت، ضمن بررسی دقیق جنگ تحمیلی 12 روزه رژیم اسرائیل علیه جمهوری اسلامی ایران، با عنایت به عناصری مانند وجود قرائن قطعی بر وقوع حمله، وجود اولویت نسبت به مصلحت دفاعی و عدم نیاز به اذن امام معصوم و با استناد به عمومات ادله وجوب جهاد، روایات و مفهوم ولایت فقیه، مشروعیت دفاع پیش‌دستانه جمهوری اسلامی ایران اثبات گشته است. https://hds.sndu.ac.ir/article_3972_7c3e68f8248b546238b9e74e07a8277d.pdf
