Abstract
Today, more than ever, the perpetrators of transgressions have transgressed across borders, with more deadly means, and targeting ethnicities, religions, groups, and the perversion of individualism, and the perpetrator is considered an enemy of community security. One example of such crimes is the genocide in Halabja. In this paper, we intend to examine in a descriptive-analytical manner the legal issues of the Halabja chemical bombing, such as the violations of various international conventions and regulations by the Iraqi Ba'ath regime, the implementation of the Iraqi Ba'ath regime's criminal behavior with international crimes, and the analysis of criminal responsibility. Iraqi Government, Investigation of Genocide Crime and Other International Crimes According to the International Criminal Court's Statute, we assess the legal system of Iran in the criminalization of genocide.Studies show that, given the material and spiritual elements of each war crime, crimes against humanity and genocide contained in Articles 5, 6 and 7 of the ICC Statute, the chemical bombing of Halabja is a clear example of genocide. Given the emergence of documented criminal law security that is influenced by the emergence of international crime, there is a substantial and substantive legal vacuum regarding genocide and insufficient crime, and the absence of criminal provisions of the Islamic Penal Code of 2013 in compliance with, and condemnation of, genocide. The universal jurisdiction of Iran's domestic courts to prosecute and prosecute the perpetrators of this crime necessitates the immediate removal of the existing legal vacuum.
